Personal Data Processing and Protection Notification

This document is inform you about the processing of your private data and your legal rights per Article 10 of the Personal Data Protection Law #6698 (“KVKK”). Please read it carefully.

Ramada Hotel & Suites by Wyndham Kemalpaşa İzmir (“Ramada”) is a Doğan Metalurji Makina Ve İnşaat Taahhüt San. Ve Tic. Ltd. Şti. (“Doğan Metalurji”) company investment. Per the KVKK, we have a Data Controller obligation towards all our customers. We need to ensure that your private personal data that we are responsible for is processed by the legislation, to protect this information and to protect the privacy of private life.  

Doğan Metalurji processes your private personal data as specified in Article 4 of the KVKK, within the framework of the laws, legal requirements, and the legitimate interests of Ramada, only in connection with the purpose requiring processing, in a limited and measured manner, protects technically and administratively, and keeps it up to date, and shares it with authorized institutions.

At Ramada, your private personal data such as identity, communication, legal transaction, physical security, transaction security, customer transaction, marketing, visual and audio records, and because of Covid health information is processed.

Your private personal data is collected and processed through Guest Registration Forms and the information entered in the Opera Hotel Automation application, by phone number +90 (232) 977 70 70, fax number +90 (232) 877 10 05 or by e-mail address @ramadakemalpasa.com extension, or the company registered mobile phones and information communicated to us via the contact form available on our website ramadakemalpasa.com. Besides, personal data is recorded by camera systems or photo-taking devices.

Your private personal data is directed to our company when a reservation is requested from our website and the reservations submitted by the website wyndhamhotels.com belonging to Wyndham Hotels and Resorts to which we are affiliated, or the tourism, organization, or brokerage companies that you share your information with your consent, booking.com, hotels.com, expedia.com, etc. It is processed by collecting and recording the information transmitted through third parties, which are real and legal persons.

Our customers staying at Ramada complete and sign the Guest Registration Form when check-in. This form includes name and surname, identity information, address, telephone, vehicle license plate, e-mail, and signature. The information in this form is entered into the Opera Hotel Automation application. 

Also, commercial message permission approval is submitted in the form. If you consent, we will communicate campaigns and advertising messages for marketing purposes.

During registration, identity checks are carried out per legal regulations. A presentation of identity is required. Per the Identity Reporting Law # 1774, your credentials are recorded in the Security Identity Notification System to carry out GBT (General Information Collection) operations and only during your stay. Information for notification is collected by filling in the fields in the guest registration form or receiving a copy of the identity card.

Your ID will be scanned and the phrase “for accommodation” will be noted. ID scans are saved in the Opera Hotel Automation application.

In group registrations, the Excel file list containing the identification information or the copies of the identities of individuals is sent to Ramada by the real or legal entity organizing the organization.

In the case of organizing restaurant, meeting, and group events, the participant list containing the name, surname, and telephone number of the person making the reservation, the name, surname, and telephone information provided by the organization owner is used.

The identity copies/scans taken after the customer leaves the hotel are subject to Article 21/2 of the Turkish Commercial Code. The invoice, which has a legal objection period according to the article, is kept within eight (8) days from the date of issuance and is destroyed on the 1st, 10th, and 20th days of each month.

Our customers can get phone, food, beverage, ironing, and dry cleaning, parking, SPA, health-related, or protective health products services during their stay in Ramada. These services are recorded in check forms and Opera Hotel Automation applications. The forms include your name, surname, room number, and signature. The services received can be seen in the detailed expense statement. 

Since the information and checks in the automation system are official documents within the scope procedures of the Tax Law, they are kept for five (5) years and destroyed by the disposal procedure.

Invoice information is shared and processed with the e-document applications of the Revenue Administration. The invoice is issued according to Tax Law No. 213. According to the Tax Procedure Law, the retention obligation is five (5) years following the year in which the invoice was issued or received, and ten (10) years in terms of the Turkish Commercial Code. Therefore, it is stored for ten (10) years and destroyed by the disposal procedure.

Your credit card and account information are processed using the POS service provided by banks and secured for payment purposes. Documents of payment records are also kept for the same period along with invoices. Credit card information is not collected and stored by Ramada.

In our hotel, the individual customer or arts, sports, commercial, etc. no photo, video, and visual recording are taken without the request and permission of the responsible person of the events and organizations. This service is carried out by our responsible employees or by persons and organizations that have a contract with our company. 

Comments and shares of the individual customer or the company that owns the events and organizations can be made on their social media accounts, provided that they obtain sharing permissions from the relevant persons. Ramada is not responsible for these posts.

The ramadakemalpasa.com, Facebook/RamadaHotelSuitesKemalpasa, Twitter @ramadakemalpasa, Instagram @ramadakemalpasa, and Linkedin/ramada-hotel-&- suites-kemalpa-a-izmir accounts of Ramada will only be shared with your explicit consent each time. These accounts are located abroad. Therefore, the transfer is made abroad.

If individuals or organization participants wish, they can add themselves to the shares and posts of our company and share their visuals and comments.

Doğan Metalurji and Ramada are not responsible for the permission, storage, distribution, and sharing of images, social media accounts, websites, and printed publications that are not the owner and responsibility of our hotel.

For marketing purposes, we will call you by our employees or send you e-mail messages using the messaging services of Modern Medya and Euromessage companies to communicate our general-purpose campaigns and announcements to you. To send these messages or to reach you by phone, we will obtain approval from you in the Guest Registration Form per the Law No. 6563 on the Regulation of Electronic Commerce and related legislation.

Per the Law # 5651 on Regulating Broadcasts on the Internet and Fighting Against Crimes Committed Through These Broadcasts, your internet access provided by Ramada is recorded by matching the room number or ID number. These records are kept for at least two (2) years. 

Images are recorded with a 24/7 camera system within the scope of Ramada’s legitimate interest and to ensure your safety or to collect evidence when an incident occurs. The cameras are not hidden and are positioned to protect privacy. Camera recordings are automatically deleted after twenty-one (21) days. To protect the mutual rights of Ramada and our customers, regarding services, transactions, and payments, an audio-video recording is taken with a visible camera at the reception.

Protel, the authorized dealer of the Opera Hotel Automation software we use within the scope of maintenance services, can access our system using a remote and secure access method. BTE company, which carries out the maintenance services of our network and security system, provides access using remote and secure access methods. We have confidentiality agreements with these companies. 

By the commercial agreements made between companies by Wyndham Hotels and Resorts, which we are affiliated with, to report revenues and customer sales and services received, it can be accessed from abroad by secure access method within the legitimate interests of the company.

KVKK Article 5 (1). We will obtain your explicit consent for the processing of your private personal data. 

However (2). within the scope of the clause; stipulated in-laws; the processing of personal data is necessary, provided that it is directly related to the establishment or performance of a contract; It is compulsory to fulfill our legal obligation; it is made public by you; Data processing is mandatory for the establishment, exercise or protection of a right; Data processing is mandatory for the legitimate interests of Ramada, provided that your fundamental rights and your privacy are not harmed; Personal data can be processed without seeking explicit consent.

Your Health Information, which is in the special quality personal data group, is not collected and processed at Ramada. However, the person who is unable to disclose his consent due to actual impossibility within the scope of Article 5 (2) paragraph of the KVKK or the person whose consent is not legally valid, is obligatory for the protection of himself or someone else’s life or physical integrity or that concerns public health. In the event of an illness, health problem, or an emergency such as an accident or injury, we may need to report the incident and the details detected to the authorized emergency response team or a public or private health institution, which is obliged to keep confidential. Law enforcement officers can be informed according to the form and scope of the incident. When necessary, it can be notified to the organization you are affiliated with and your relatives to reach you or to make them aware of the incident, without sharing special personal data. Regardless, Ramada does not perform any data processing, unlawful sharing, or storage of data in this case.

You may be asked for some information in addition to the records we regularly keep, during situations involving public health and in cases such as entering the hotel, accommodation, meeting and organization participation and benefiting from the hotel’s services. This information includes information such as contact information of the person to be contacted in case of emergency, fever measurement, a questionnaire about general health status, international travel history, health-related illness or disease symptoms that may have occurred about you or your relatives. You may be asked to use protectors such as masks during your stay at our hotel. Besides, your approval is obtained that isolation and quarantine may be applied in case of illness during your stay at our hotel. These records can be processed by company employees that we authorized. Records are kept meticulously for a while required by the legal legislation in a place determined for this work. It is then destroyed by the disposal procedure.

Your personal information can be shared with our Law Office when legal action is required.

Apart from the specified above, no personal data is processed in Ramada, data is not transferred or shared with third parties in Turkey or abroad. 

Your private personal data can only be shared with legally authorized institutions and/or by law.

Violation events that may affect the confidentiality, integrity, and accessibility of your private personal data will be evaluated carefully and in case of detection of a violation of your private personal data illegally obtained by unauthorized real and/or legal persons or institutions, alteration, etc., per Clause (5) of Article 12 of the KVKK, the Personal Data Protection Board will be informed.

As per Article 11 of KVKK, you have the rights about your private personal data, and request information if processed; learning whether it has been processed; learning the purpose of processing and whether it is used appropriately; to know the third parties in the country/abroad; request correction if incomplete/incorrectly processed; to request their deletion/destruction within the framework of the conditions stipulated in Article 7 of the KVKK; to request the third parties to whom it is transferred to be notified of the transactions made in the above-mentioned subjects; to object to the emergence of a result against you because it is analyzed exclusively by automated systems; to request the compensation of the damage in case you suffer damage due to unlawful processing.

According to Clause (1) of Article 13 of KVKK, you can request information regarding the reasons explained above, sending to Ramada Kemalpasa, Kemalpaşa OSGB Ankara Asfaltı Cad. 24 km Kemalpaşa 35735 İzmir or kvkk@ramadakemalpasa.com by filling in the Personal Data Information Request form containing your requests in a clear and comprehensible manner, personally signed and with the documents determining the identity and contact information (Passport ID, e-mail, telephone, address). 

Your requests will be concluded as soon as possible and within thirty days at the latest, depending on their complexity. However, if the transaction requires an additional cost for Ramada, the fee may be charged.
